Lawsuit claims special needs student was injured while being restrained

    Bakersfield, CA (KERO) — A lawsuit has been filed against the Kern High School District alleging a special needs student was injured after being “improperly restrained” by employees.

The lawsuit claims that in December 2016, a student enrolled in special education was improperly restrained, resulting in a fracture to his left arm. This caused the student to be require medical treatment.

According to the lawsuit, the student also suffered “extreme mental anguish, emotional injuries and physical pain and suffering.”

The suit claims that employees acted with negligence and accuses employees of assault and inflicting emotional distress on the student. The family is seeking unspecified damages including attorney fees and medical expenses.

The case will be discussed by the Kern High District’s Board of Trustees on Friday.
