Gallatin County Commission to consider settlement in Bear Canyon lawsuit

BOZEMAN, Mont. – Gallatin County Commissioners will consider a settlement given to them by the state regarding the Bear Canyon Road Lawsuit.

The lawsuit was filed by the county back in 2012 because they said U.S. Forest Service vehicles had obliterated Bear Cayon Road in 2007, making it impassable for citizens wanting to access trails through the road where it enters state land.

The state said the road was not county property but the county disagreed and took legal action to confirm the road was under Gallatin County’s ownership and to ask for damages for trespassing.

The settlement asks that the county dismisses the lawsuit with the road being recognized as county property and both parties pay their own attorney fees and court cost.

The settlement will be brought forward to the commission at 9 a.m. at the Gallatin County Courthouse.

The county also has another suit against the U.S. government regarding a different section of Bear Canyon Road.
