BOZEMAN, Mont. – The Gallatin County Commission unanimously voted Tuesday morning to approve the settlement regarding the Bear Canyon Road lawsuit.

The county filed the lawsuit in 2012, claiming U.S. Forest Service vehicles had obliterated Bear Canyon Road in 2007, making it impassable for citizens wanting to access trails through the road where it enters state land.

The state claimed the road was not county property, resulting in the county taking legal action.

With the settlement approved, the county will dismiss the lawsuit, with Bear Canyon Road being recognized as county property. Both parties will pay their own attorney fees and court costs.
